Terms and conditions

1. Purpose
These terms and conditions of use (hereafter « T&Cs ») govern the use of the site obv.studio (hereafter the « Site ») published by Rafael Janosevic.
The Site allows users (hereafter « Members ») to participate in cultural surveys conducted by obv.studio, view published results, and enter prize draws at the close of completed surveys.
By creating an account on the Site, the Member acknowledges having read these T&Cs and accepts them without reservation.
2. Account creation
Access to certain features of the Site requires creating an account. The account is created by entering a valid email address, then confirming that email via a link sent by obv.studio.
Account creation is free. It is reserved for individuals aged 18 and over. The Member undertakes to provide accurate information at registration and to keep it up to date.
The Member is solely responsible for the confidentiality of their account credentials. Any fraudulent use of their account must be reported without delay to rafael@obv.studio.
3. Use of the service
The Member undertakes to use the Site in good faith and to answer surveys honestly. Frivolous, insulting or defamatory responses, or responses intended to skew study results, may result in account deletion without notice.
Responses provided by Members are processed anonymously in published studies. Verbatims cited in reports cannot be linked to the Member's identity.
4. Prize draws
At the close of each completed survey, a prize draw is held among Members who have fully completed the survey. A survey may be aimed at a specific group: anyone outside it stops after the first questions and is not entered in the draw. The winner is selected at random via an automated process.
When a survey offers optional topics, each completed topic gives an extra chance in the draw, and the draw takes into account the number of chances each participant has.
The winner is notified by email and has 30 days to claim their prize by providing a postal delivery address. After this period, the prize is considered forfeited. Physical prizes are delivered in France; for an address abroad, obv.studio may offer a prize of equivalent value.
Prizes are non-exchangeable, non-refundable, and cannot be converted into cash. obv.studio reserves the right to replace a prize with another of equivalent value in case of unavailability.
Entry is free and no purchase is necessary. The prize and the draw date are stated on the page of each survey.
obv.studio prize draws are in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc. (Facebook, Instagram) or any of its affiliates. By taking part, the Member releases Meta from any liability related to these draws.
4A. Side Window giveaway (14 September to 21 October 2026)
The terms below apply to the giveaway run alongside the Side Window survey on friendship. They prevail over section 4 for this giveaway only.
- Organiser's name: Laura Avice and Sara Lucchese, for Side Window.
- Time period: from the 14th of September 2026 to the 21st of October 2026 inclusive.
- Eligible territories: France, Denmark, Spain, United Kingdom.
- Eligibility requirements: entrants must be between 20 and 65 years old on the date of entry (minimum age: 20).
- Prize: an Airbnb gift card.
- Number of winners: 1.
- Drawing procedure: random drawing.
- Date of the drawing: 21 October 2026.
- Method of contact: email.
- Timeframe within which the winner must respond: one week from the date they are contacted.
- If the winner does not respond: if the winner does not answer within a week, another name is drawn.
- Data processing: entrants’ data is processed as described in our privacy policy.

5. Intellectual property
All content on the Site (studies, analyses, aggregated verbatims, visual identity, logo) belongs to Rafael Janosevic. Any reproduction or reuse requires prior written permission.
By submitting responses to surveys, the Member grants obv.studio a non-exclusive, royalty-free right to use those responses anonymously in published studies, client reports, communications and associated editorial content.
6. Sales, payments and licence (Shop)
Pricing and VAT
Prices are displayed in euros, the same for all buyers (business or individual). obv.studio operates under the French VAT exemption scheme (article 293 B of the French General Tax Code): the note "VAT not applicable, art. 293 B du CGI" appears on every invoice and no VAT is charged.
Payment
Payment is processed securely by Stripe Payments Europe, Ltd. obv.studio does not store payment card details at any time. By completing the order, the buyer accepts Stripe's terms of service.
Licence
Each report is sold with a licence to use it (business or personal), not a transfer of ownership. What it covers, what it allows (including quoting in your presentations) and what it prohibits (including sharing outside the company and uploading to artificial intelligence tools) are set out in the licence terms, which the buyer accepts at checkout.
Delivery and download
Files (PDF, presentation) are available immediately after payment confirmation, via the customer area My account. Downloads are unlimited and tied to the buyer's account.
No right of withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content provided immediately after purchase without physical medium. By completing the order, the buyer expressly acknowledges waiving their right of withdrawal and accepts that delivery is carried out immediately.
Complaints
For any complaint relating to a purchase: rafael@obv.studio. obv.studio undertakes to handle each request within 5 business days.
7. Personal data
The processing of personal data is detailed in our privacy policy. The Member may at any time exercise their rights of access, rectification, erasure and portability of their data.
8. Liability
obv.studio makes every effort to ensure the availability of the Site but cannot guarantee uninterrupted access. The publisher shall not be liable for temporary unavailability of the Site, maintenance, or force majeure events.
The Site may contain links to third-party sites. obv.studio accepts no responsibility for the content of those external sites.
9. Termination
The Member may delete their account at any time from the My account page, or by writing to rafael@obv.studio. Deletion results in the erasure of their personal data within 30 days (see privacy policy).
obv.studio reserves the right to suspend or delete an account in the event of a breach of these T&Cs, without notice or compensation.
10. Amendment of T&Cs
obv.studio reserves the right to amend these T&Cs at any time. Members will be informed by email of material changes. Continued use of the Site after amendment constitutes acceptance of the updated T&Cs.
11. Governing law and jurisdiction
These T&Cs are governed by French law. In the event of a dispute, an amicable resolution will be sought before any legal action. Failing that, the French courts shall have sole jurisdiction.
